What these terms cover, and how they are accepted

These Terms of Use set out the conditions on which any visitor may use the site at https://odin337.ru, across all of its pages including the English version at /en, however that visitor arrived: from search, from a link, or directly.

These terms govern the use of the site and nothing else. They are not a contract for services and they say nothing about scope, deadlines, acceptance, warranties or payment: all of that is fixed in a separate contract signed with the client. No page of this site, no submission of the contact form and no correspondence that follows concludes such a contract by itself.

Using the site — opening any page, reading the materials, submitting the form — means you accept these terms. Russian law treats conduct of that kind as acceptance in itself (Articles 158(2) and 438(3) of the Civil Code of the Russian Federation), so no signature and no click-through are required for these terms to apply. If you do not accept any part of them, stop using the site.

These terms are themselves a proposal made by the operator to the visitor, accepted in the way just described. In that they differ from the commercial information on the site — prices, package contents, timelines and the calculator result — none of which is a proposal to conclude a contract. The distinction is worked through in the section on public offers below.

The site is addressed to adults enquiring about professional work. The contact form is not intended for submissions made by or on behalf of children, and the operator does not knowingly collect a minor's personal data.

These terms are published in Russian and in English. The English text is a translation provided for convenience. If the two versions diverge, the Russian text prevails.

Who operates this site

The site belongs to, and is run by, an individual entrepreneur — a registered sole trader under Russian law, personally liable rather than shielded by a company. There is no team over which responsibility is spread: one named person answers for the content of the site, for the obligations taken on through it, and for the processing of personal data.

Information on this site is not a binding offer

The prices, package contents, timelines, calculator result and any other commercial terms published on this site are provided for information. They are not a public offer within the meaning of Article 437(2) of the Civil Code of the Russian Federation.

The distinction matters. Under Article 437(2) of the Civil Code, a proposal that contains every essential term of a contract and shows an intention to be bound by whoever responds counts as a public offer: the person accepting it binds the person who published it, without any further agreement. A published price list with timelines and a payment schedule looks a great deal like such a proposal. This clause states the opposite intention, which Article 437(1) permits: everything commercial on this site is an invitation to make offers — an invitation to discuss a brief, not a contract waiting to be accepted.

The calculator returns an indicative range, not a quotation. It works from coefficients fixed in advance and from the answers you typed in; it cannot see your project, your infrastructure or your deadlines. The lower and upper bounds of the range frame the conversation that follows — they are neither a price nor an estimate prepared for your case.

The final price, the scope of work and the timeline are fixed only in a signed contract. Until it is signed, no figure published on this site — the calculator result included — binds either the operator or the visitor.

The site publishes two price lists: one in roubles for the Russian market and one in dollars for the international market. They are two independent price lists, not one price list shown in two currencies. Neither is derived from the other, no exchange rate is applied to either, and an amount in one currency is not the equivalent of an amount in the other. Which list you see follows the language version of the page, never your location.

The operator may change prices, package contents and timelines at any time and without notice, and may decline to discuss a project without giving reasons. Submitting the contact form places the operator under no obligation to reply, to prepare a proposal or to start work.

Payment arrangements and the applicable tax treatment are settled in the contract. The note on tax treatment shown on the pricing page is there for reference only.

Intellectual property

The source code of the site, its design, layout, texts, graphics, animation, three-dimensional scenes, sound design and the structure of its sections are protected by copyright (Article 1259 of the Civil Code). The exclusive rights in them belong to the operator unless a particular item says otherwise beside it.

The names ODIN337 and ODIN337 Studio, the logo and the runic marks used in the design identify the operator's business. They are not registered as trade marks; they are protected as works of authorship and as marks the operator uses in fact.

Without asking for anything further, you may:

  • read the materials, save them and print them for personal, non-commercial use;
  • quote the texts to the extent justified by the purpose of the quotation, naming the author and giving a working link to the source page (Article 1274(1) of the Civil Code);
  • share links to any page of the site freely.

Without the operator's prior written permission, you may not:

  • copy the design or the source code of the site in whole or in substantial part, including with the colours, typefaces and wording swapped out;
  • use the names ODIN337 and ODIN337 Studio, the logo or the marks in your own materials, domain names, account names or advertising, or in any way that suggests a connection with the operator;
  • present the materials as your own or strip the attribution from them;
  • harvest the materials systematically and automatically at a rate above ordinary human browsing;
  • use the materials to train machine-learning models.

The site is built on open-source software and uses typefaces licensed from their rights holders. This section does not extend to those components: each of them is governed by its own licence.

Client names, logos and materials shown in the work section belong to their respective rights holders and appear with their permission — see the next section.

Client work and confidentiality

The case studies published here appear with the clients' permission. Work carried out under a non-disclosure agreement is described without identifying the client: no name, no logo, no recognisable materials, and no figures belonging to the client's business.

A name missing from the work section means nothing in itself: some projects are not published at all. Asked by a third party, the operator will neither confirm nor deny having worked with any particular client.

What you write in the contact form, and in the correspondence that follows, is not published and is not used in marketing materials without your separate agreement.

Do not send passwords, access keys, other people's personal data or trade secrets through the contact form. It is not built for that: material of this kind is exchanged only after a non-disclosure agreement has been signed.

Acceptable use

When using the site, you must not:

  • obtain or attempt to obtain unauthorised access to the site, to the lead-receiving server, to the database or to any account, or probe them for vulnerabilities without the operator's written permission;
  • circumvent or attempt to circumvent the Yandex SmartCaptcha check, the hidden honeypot field or any other protection on the contact form;
  • generate automated load beyond ordinary human browsing, including bulk requests and disregard of the limits declared in robots.txt;
  • use the contact form to send advertising or other unsolicited commercial messages: distributing advertising over communication networks without the recipient's prior consent is prohibited by Article 18 of Federal Law No. 38-FZ on Advertising;
  • enter another person's personal data into the form unless that person has agreed to it being passed to the operator;
  • transmit through the site any material that breaks the law or infringes the rights of others, or that contains threats, abuse or malicious code.

The operator may restrict access from addresses that breach these rules and may keep the technical records of those requests. That is a protective measure rather than a penalty, and it does not replace the remedies the law provides.

If you find a vulnerability, report it to privacy@odin337.ru instead of exploiting it. A report made in good faith — without harming anyone else's data, without extortion and without publishing before the fix — is treated as help, not as a breach of the rules above.

Outbound links and third-party services

The site links out to external resources — client sites, documentation, open-source projects. The operator does not control their content, their availability or how they handle data, and is not responsible for any of it. A link is not an endorsement or a recommendation. Once you follow one, the rules of that resource apply to you, not these terms.

Three third-party components run on the pages of this site, and this is the complete list:

Yandex SmartCaptcha
Protects the contact form against automated submissions. The widget loads on the page carrying the form and the result is verified on the server: without a successful check nothing is stored. The service is Russian and no data leaves the country.
Yandex Metrica
Web analytics, including session recording (Webvisor). It loads only after you have explicitly opted in. Declining means the script is never loaded at all, not that it loads and is asked not to count. The details are in the cookie policy.
Site hosting
The pages, scripts, stylesheets and fonts are served from the operator's server in Moscow — the same one that stores the enquiries. No third-party cloud platform or CDN is involved. The data path is described in the privacy policy.

There are no advertising networks, no third-party advertiser trackers, no social-media widgets, no support chat and no external form service on this site. Nor is there any analytics system other than the one named above — Russian or otherwise.

Disclaimer and limits of liability

The site is provided as is. The operator does not warrant that it will run without interruption or without error: it may be unavailable because of maintenance, a hosting failure, a network problem or circumstances outside the operator's control. No undertaking is given to announce planned maintenance in advance.

The materials are informational. The operator keeps them current but does not warrant that every text, price or timeline is accurate at the moment you read it, nor that any of it is fit for a particular purpose. Nothing published here is advice on which a decision should be taken without checking it independently.

So far as the law allows, the operator is not liable for losses arising from the use of the site or from an inability to use it, including lost profit and the consequences of decisions taken on the basis of the published materials.

These limits apply only so far as the law permits them to be agreed, and no further. An agreement made in advance to remove or limit liability for an intentional breach is void (Article 401(4) of the Civil Code). Where the visitor is a consumer, any term that cuts into the rights the law gives them is void (Article 16 of the Law on the Protection of Consumer Rights). Nothing in this section limits liability for the processing of personal data, which is governed by Federal Law No. 152-FZ.

If any single provision of these terms turns out to be invalid, the rest remain in force, and the invalid provision applies to whatever extent it lawfully can.

Personal data

How personal data is processed is set out separately and is not repeated here: see the privacy policy. The text of the consent you give when submitting the form is published as a separate document, and what is written to your browser is covered by the cookie policy.

The contact form can only be submitted once you agree to that text. Consent may be withdrawn at any time by writing to privacy@odin337.ru; what to put in that message and how quickly the operator answers are set out in the consent text itself, while your rights as a data subject are enumerated in the policy.

Governing law and disputes

These terms, and any relationship arising from the use of the site, are governed by the law of the Russian Federation — wherever the visitor is located and whichever language version they used.

  1. Negotiation first. Write to privacy@odin337.ru or use the contact form: most questions are settled at this step.
  2. A written claim is a mandatory pre-action step under Russian procedure. Send it to the operator's email address or postal address; it will be considered within 30 calendar days of receipt.
  3. If the claim is refused, or no answer arrives within that period, the dispute goes to the Chertanovsky District Court of Moscow — the court for the operator's place of business.

Where the visitor is a consumer, the statutory rule letting the claimant choose the court (Article 17 of the Law on the Protection of Consumer Rights) applies regardless of the paragraph above and cannot be restricted by these terms.

Changes, version and effective date

The operator may amend these terms. The version in force is always published at /legal/terms; its version number and effective date appear at the top of the document.

A change takes effect when the new version is published, unless that version names a later date. Continuing to use the site after that moment means accepting the amended terms. A change affecting the rights or obligations of the visitor raises the minor version number; a typo fix or a clarification that does not alter the meaning raises the patch number only.

Superseded versions remain recoverable: the text of these terms is held in the project's version history, so any earlier wording can be retrieved by its number. If you need to know which text was in force on a given day, ask for it at privacy@odin337.ru.

These terms do not replace a contract for services and do not alter its conditions. Where these terms and a signed contract differ, the contract governs the relationship between its parties.
